These general terms of use (the " Terms of Use ") govern access to and use of the Foxar application (iPhone, iPad, Apple Vision Pro) as well as the Foxar website and web application (the " Service ") by any person who uses them (the " User").

The purchase of a subscription or a paid service is also governed by our general terms and conditions of sale (GTCS).

1. Legal notice - publisher

The Service is published by:

  • Foxar SAS, a simplified joint-stock company with share capital of €50,000

Hosting is provided by Scaleway (data centers located in France).

2. Acceptance of the Terms of Use

Registration for or use of the Service implies full and unconditional acceptance of these Terms of Use. Upon registration, the User expressly accepts the Terms of Use by checking the corresponding box. In the event of disagreement, the User must refrain from using the Service.

Foxar may modify the Terms of Use at any time; the applicable version is the one in force at the time of use. In the event of a significant change, the User is informed and, where applicable, invited to accept them again.

3. Description of the Service

Foxar offers educational applications enabling users to explore and understand through 3D visualization, augmented reality, guides and interactive content (quizzes, etc.).

The Service includes:

  • free features;

  • paid features reserved for Foxar+ subscribers, governed by the GTCS.

Foxar may develop, add, or remove features at any time.

4. Access and account

The Service is accessible to anyone with Internet access. The costs necessary for access (hardware, software, connection) remain the responsibility of the User.

Certain features require the creation of an account. The User undertakes to provide accurate and up-to-date information, to keep their credentials confidential (password or access keys "passkeys"), and to report without delay any unauthorized use. They are responsible for activities carried out from their account.

The User may delete their account at any time from their personal area or by writing to contact@foxar.org.

Minors and school context

The Service is intended for educational use and may be used by minors. In a school context, login may take place via GAR (French Ministry of Education, France), with pseudonymous accounts. Outside a school context, an account relating to a minor is created and used under the responsibility of a parent or legal representative, in compliance with the minimum age applicable in their country. The conditions for data processing are detailed in our privacy policy.

5. Rules of use

The User undertakes to use the Service fairly and lawfully. In particular, they are prohibited from:

  • using the Service for illegal or fraudulent purposes, or in a way that infringes the rights of third parties;

  • using the Service or its content for commercial purposes without Foxar's written authorization;

  • attempting to access systems without authorization, circumvent security measures, or disrupt the operation of the Service;

  • copying, modifying, decompiling, or reverse engineering the application, except within the limits permitted by law;

  • introducing unlawful or malicious content, or harmful programs.

Any breach may result in the suspension or termination of the account (Article 9).

6. Intellectual property

The trademarks, logos, and all content of the Service (texts, images, sounds, 3D models, code, etc.) are protected by intellectual property law. The Foxar trademark is registered by Foxar SAS.

Foxar grants the User a personal, non-exclusive, and non-transferable right to use the Service under these Terms of Use. Any reproduction, representation, or exploitation, in whole or in part, without prior authorization, is prohibited and may constitute infringement (Articles L335-2 et seq. of the French Intellectual Property Code). The User must not remove or modify copyright notices.

7. Availability, maintenance, and force majeure

Foxar strives to ensure the availability of the Service but does not guarantee uninterrupted or error-free operation. The Service may be suspended or modified, in particular for maintenance. Foxar may not be held liable in the event of interruption, malfunction, or delay resulting from force majeure or from the unforeseeable and insurmountable act of a third party.

8. Liability

The content provided is presented for informational and educational purposes only, without contractual value; Foxar does not guarantee its completeness or the absence of errors. Foxar may not be held liable for:

  • the use or interpretation of the information contained in the Service;

  • use that does not comply with these Terms of Use;

  • any damage affecting the User's equipment when accessing or downloading.

Nothing herein limits Foxar's liability in cases of fraud, gross negligence, or where prohibited by law.

9. Precautions - augmented reality

The use of augmented reality content may lead the User to move around in space without full awareness of their surroundings. The User must remain attentive to their surroundings and ensure their own safety and that of the people around them (presence of objects, layout of the premises, etc.).

10. External links

The Service may contain links to third-party sites. Foxar exercises no control over these sites and disclaims all liability regarding their content.

11. Suspension and termination

Foxar may suspend or terminate a User's access, without prior notice in the event of a serious breach of these Terms of Use or of the law. The User may terminate at any time by deleting their account; the conditions specific to paid subscriptions are set out in the GTCS.

12. Personal data and cookies

The processing of personal data and the use of cookies are described in our privacy policy, which forms an integral part of the contractual relationship.

13. Applicable law, mediation, and jurisdiction

These Terms of Use are governed by French law, without prejudice to the mandatory protective provisions applicable in the country of residence of the consumer User.

In the event of a dispute, the User is invited to contact Foxar in order to seek an amicable solution. In accordance with consumer law, the consumer User may have free recourse to a consumer mediator. Failing an amicable resolution, the dispute shall be brought before the competent courts.
